Strict No-Refund Policy Notice
Please be advised that all payments made to Dustwon Technology (Dustwon Private Limited) for custom software engineering, CRM & ERP development, digital services, and milestone retainers are 100% Strictly Non-Refundable under all circumstances once initiated or delivered.
1. Core No-Refund Principle for Digital & Custom Services
Unlike physical off-the-shelf consumer goods, custom software development involves dedicated engineering human-hours, specialized system architectural design, code writing, and irrevocable cloud server compute resources. Because developer time and intellectual engineering effort cannot be restored once allocated, no refunds (full or partial) will be granted for any completed, in-progress, or scheduled milestone.
2. Advance Deposits, Token Fees & Milestone Payments
- Initial Advance / Booking Deposits: All advance payments, discovery phase charges, and project kick-off deposits are non-refundable. These funds immediately reserve technical staff, reserve server staging infrastructure, and initiate project research.
- Milestone Payments: Once a project milestone (e.g. Wireframe Approval, Backend API Scaffold, Beta Testing) is completed or commenced, the corresponding milestone invoice is non-refundable.
- Change of Mind: If a client changes their mind, alters their internal corporate strategy, experiences leadership changes, or decides not to proceed with the project, no refund will be issued.
3. Third-Party Costs & External Disbursals
Under no circumstances can Dustwon Technology refund expenses disbursed to external third-party service providers on the client's behalf. These non-refundable items include, but are not limited to:
- Domain name registrations and renewals (ICANN registrars).
- Third-party cloud server subscriptions (AWS, DigitalOcean, Google Cloud, Azure).
- SSL Certificates and security CDN subscriptions.
- Transactional SMS gateways, WhatsApp Business API credits, and email delivery service packages.
- Third-party software licenses, API subscriptions, and paid plugin assets.
4. Project Cancellation Protocol
A client may terminate an ongoing development contract by submitting formal written notice at least 15 calendar days in advance to support@dustwon.com. Upon receipt of cancellation notice:
- All technical work will be stopped at the conclusion of the 15-day notice period.
- The client remains responsible for settling all unpaid work completed up to the date of termination.
- Already disbursed funds will NOT be refunded in cash or bank transfer.
- At Dustwon Technology's sole discretion, unutilized milestone credit may be retained as a Credit Note valid for 6 months toward future software maintenance or alternate modules.
- Any work completed and paid for in full will be packaged and delivered to the client as-is.
5. Defect Rectification Instead of Financial Refund
If a client is dissatisfied with a technical milestone deliverable, the remedy provided by Dustwon Technology is technical rectification and bug resolution within the 30-day post-launch warranty window. Our senior engineering team will review discrepancies against the agreed Statement of Work and perform necessary code revisions at zero additional charge to bring deliverables in compliance with the signed scope.
6. Prohibition of Unilateral Chargebacks
Clients agree that they will not initiate unilateral credit card chargebacks, payment gateway disputes, or false fraud claims with banking institutions without first exhausting written dispute resolution procedures with our management. Initiating an unauthorized chargeback constitutes a material breach of contract, resulting in immediate termination of server licenses, removal of source code deployment, and potential legal recovery proceedings under Raipur, Chhattisgarh, India jurisdiction.
